ELG-2012-001 CWA District 2-13 and all affected WV CBA 142 Locals and Frontier

The purpose of this is to notify you a settlement was reached between CWA and Frontier for ELG -2012-001 regarding payment of differentials on excused workdays, and as amended in December 2014 will include payment for differentials on holidays as well. Both were in violation of Article 19 and 38, Section 2 of the CBA. The ELG was scheduled for arbitration hearing on September 29, 2015, but the parties reached a settlement and postponed the arbitration hearing pending the final execution of this Settlement Agreement.

Therefore, as per the attached Settlement Agreement Exhibit A, it has been agreed Frontier will pay the differentials due to employees as contained in Article 19 and 38, Section 2, for excused work days and holidays on a prospective and retroactive basis. Both patties have agreed to the following method of payment:

• Going forward on a prospective basis all differentials will be paid for the term of the CBA General Agreement on the employee's pay check.

• For all retroactive back payments, Frontier has agreed to make these payments dating back to, November 21, 2012, which is a period of 30 days prior to the filing of the original ELG on December 21, 2012. The retroactive payments will be made to employees in one lump sum basis in the gross amount on August 12, 2016. Reminder - All payments are subject to applicable withholding and/or deductions, and will be reported on the employee's annual W-2 Form.

Therefore, any bargaining unit employee who does not receive a differential payment yet they feel they are due should notify their Union Local President. The employee will be required to provide their Local President a copy of both the check stubs and schedule/s to validate and substantiate their claim for lack of payment. Once received from the Local, the District Office will then present this information to Frontier, who will in turn validate the fact that payment is due to the employee.

UPDATED INFORMATION: Change of Date Retro Payments Will Be Made The retroactive differential payments will be made to employees on August 19, 2016 instead of August 12, 2016 and the 45 calendar day period will begin on August 19, 2016 and will run through October 3, 2016. Per Mike Linkous, supervisors have been made aware that the diiferential payments are to be paid on a prospective basis for EWDs and Holidays.
